A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation stems from a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. After his return to the United States to face alien smuggling allegations, he was detained in federal custody.

In her decision, the court pointed out that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
